Anyone eligible in EB1A and EB2-NIW(national interest wavier) can self-petition for a green card without sponsorship. You can find more details in our pdf FAQ booklet.

Please see the EB1A and EB2-NIW criteria set by USCIS. Many Phds due to the nature of their work can meet these criteria.

Best of luck

EB1A requires substantial evidence in support of extraordinary ability. While just one publication can be counted towards one of the criteria, the petition examiner might expect it to be exceptionally good or expect that the remaining evidence is very strong.

As of today, USCIS does accept premium processing applications for the self-petition EB1A.

Best of luck

Hi, I have two questions regarding I-140 for EB1A and I would really appreciate your help.
Question 1: I have only reviewed one paper for a journal. Do you think this would be enough evidence to fulfill one of the criteria?
Question 2: I am applying by myself, without lawyers, and I was wondering if I can still apply for premium processing, and if you think this is helpful (my PD is current).
Thank you!

There are two self-petition categories where petitioners of any nationality can self-petition for a GC provided they satisfy the criteria set by uscis. The two categories are EB1a and Eb2-niw. You can review the criteria for these categories to see if you are eligible. A petitioner need not be residing in the US during the application.

Also looking at some example petition packets may be helpful to see how you can prepare a self-petition.

A self-petition requires a strong case as a person with extraordinary ability or a petitioner in the "national interest" circumstance. Please review the uscis criteria for EB1a and EB2-NIW to see if your evidence supports one of these categories. For most nationalities, obtaining a GC via EB1A can be less than a year. While EB2-NIW is also quick, for some nationalities it can take several years (sometimes 5 or more years for Indian and Chinese nationalities). You can see typical processing times on USCIS website.

Best of luck

While petitioners with similar experience have been successful, much depends on how the entire petition is presented and what the supporting evidence is included. Please review USCIS EB1a and EB2-NIW criteria and some example petitions to see how to prepare a successful petition.

I have a Master's degree and an active H-1B visa (got it a couple months ago). Work for a state agency, have 2 papers published. Should I do a self-petition. And, if for some reason it is denied, can I re-apply later through my employer? Applying through my state agency would take more than 7 years before I get the green card.

Thanks for your advice.

Hi

I have BS in chemistry. I received my MS in chemistry from USA and my PhD in chemistry from south Korea. I have published 10 scientific papers.

Would you please help me to know if I can apply for green card?

Should I come to USA for a post doc and then apply or I can apply it while I am in south Korea?

Please give me your advice.

Thanks.
