Question

I am 3rd year Ph.D student and would like to apply for green card self petition.
My B.S. Was in Pharmacy. My PhD will be in molecular biology and NMR.
I did apply for lottery green card. Do you think I can purchase the package and do it. My self. Or I’m no more eligible.

You can to do it yourself. You can always apply i-140 petition multiple times. Also unlike diversity visa, you can apply multiple  self-petition applications simultaneously in eb1a or eb2-niw. However, you need to satisfy the uscis conditions for the category you plan to apply for. Please look at  uscis requirements and also some example petitions to see how you can plan to apply an i-140 petition.

Question:

I am from India. i have done my PhD in Biotechnology. currently pursuing my post doc in NCBS. My husband is visiting US with H1 Visa and i will be getting H4. I am very much interested to continue my research career in US. In H4 visa i am not eligible to work. hence anybody please suggest regarding how to converting my H4 to a valid work visa (either a J1 or H1 or EAD or anything related) so that i can continue my postdoc or can be employed by any of the biotech companies in US. please give suggestion.

Answer

For either J1 or H1, you need a company interested in hiring you and sponsoring your visa.

You could obtain an EAD if you self-petition in EB1A or EB2 niw. You need to meet the USCIS requirements for these categories and pool sufficient evidence for your petition. You can refer to free e-book on the website.

U.S. Citizenship and Immigration Services (USCIS) has a  new fee schedule that goes into effect starting Nov. 23, 2010.  According to USCIS,  ”Applications or petitions postmarked or otherwise filed on or after this date must include the new fee, or they will be rejected”. After a comprehensive review of public comments, USCIS published the new fee schedule in the Federal Register on Sept. 24, 2010. The new fee schedule increases application and petition fees by an average of about 10 percent.
